Charleston wedding planner gets $35k bond on fraud charges

CHARLESTON, SC (WCSC)- A Charleston wedding planner was back in court on Friday to face charges of fraud which were originally dismissed earlier this year.

Robert Lawson Smith, better known as Lawson Roberts,? was charged with four counts of financial transaction card fraud and three counts of breach of trust with fraudulent intent.

Smith faced those charges earlier this year, but the charges were dropped in February because court officials said prosecutors did not have specific dates of the alleged card fraud.? At the time, prosecutors said they would come back with warrants for each specific date in the case.

Authorities say Smith's original arrest stems from a report filed in August of 2011 by?Wendy Shearer, a Miami woman who contacted police regarding possible fraud committed by Smith.

Shearer said she and her husband had hired Smith as their wedding planner in October of 2010. A police report states that the couple paid Smith a total of $65,000 for their wedding.

According to the woman, $63,000 of those funds were to pay vendors who had contributed to the wedding.?

Police say the woman then received a call on May 16, 2011 from her husband's credit card company stating that there were charges starting to show up on the couple's card. Authorities say an investigation revealed that Smith had not paid some of the vendors and used the victim's credit card to charge an additional $28,000 in funds.

FCC demands carriers protect customer privacy in declaratory ruling

Privacy has been a hot-button topic of late, no more so than in the area of telecommunications. Perhaps as a response to these concerns, the FCC voted today for a Declaratory Ruling that all carriers must safeguard the private data in their customers' mobile devices. This data is known as customer proprietary network information (CPNI) and consists of metadata like phone numbers, call duration, call locations and call logs. Providers are supposed to protect such data already, but until today that only applied to the network -- now phones are covered under it as well. Carriers are still allowed to collect the information for network support purposes, but all precautions must be met so it's not compromised. It appears that third-party apps and services aren't covered under the ruling, and there aren't any strict regulations on how the CPNI may be gathered or protected. Still, the FCC made it clear that if any of the data is exposed, the carriers would have some serious 'splainin to do. To learn more about the ruling, check out the press release after the break.

Apple reportedly clinches longsought TSMC manufacturing deal

Rumors of Apple switching its chip manufacturing from Samsung to TSMC have persisted for a long, long time. However, they may be more substantial this time around: the Wall Street Journal claims that Apple quietly signed a deal with TSMC earlier this month. The agreement reportedly has TSMC take over some of Apple's chip production in 2014. Technical setbacks kept the agreement from happening any sooner, according to the sources. Neither company is commenting on the accuracy of the story, although few would doubt Apple's incentives to reduce its dependency on Samsung-made silicon -- it's not keen on funding a primary competitor.

(AP) ? China's law enforcers are having an unusually public debate about a delicate topic: Do paid sexual services known as "happy endings" at massage parlors count as crimes if they don't involve actual sexual intercourse?

While prostitution is illegal in China, its boundaries are being discussed with rare candor by courts, police and state media ? even the usually stodgy flagship newspaper of the Communist Party.

"Various places have different standards for whether masturbation services are a crime; judicial interpretation urgently needed," read a headline of the People's Daily newspaper, which usually spends its time lecturing party members about discipline or obscure ideological issues.

The debate centers on sexual services provided by employees of usually low-end massage parlors or hair salons, advertised to customers with colorful phrases such as "hitting the airplane" and "breast massage."

While common in Beijing and many other Chinese cities, the services became part of a conspicuous national conversation only this week, following newspaper reports about a crackdown that fizzled in southern Guangdong province.

Police in the city of Foshan arrested hair salon staff for providing sexual services, only to have prostitution charges against them overturned by a local court. A precedent apparently was set last year when the Foshan Intermediate People's Court threw out a verdict against a group of salon staff, including three managers who had been sentenced to five years' imprisonment for "organizing prostitution."

Now courts, police, prosecutors, lawyers and academics are being quoted discussing oral sex and other types of sexual services facilitated by body parts excluding genitals, typically taboo topics that have captured the public's attention.

The question is whether such services can be considered prostitution if there is no intercourse.

Technically, no ? at least according to the highest court in Guangdong province, which says such services fall outside the legal definition of prostitution.

On its official microblog, the court pressed the legislature to clear up the matter, saying that although no law bars such services, they "significantly damage social order and have a certain degree of social harm."

The high court in eastern Zhejiang reportedly concurs that if there is no intercourse, there's no prostitution, but police in the capital Beijing, southern Guiyang and elsewhere disagree. The discrepancy in views is unusual in a society where police, prosecutors and courts are often seen as working in lock-step with one another.

The debate also highlights how much more open urban Chinese have become in their attitudes toward sex, as prosperity rises and government controls on personal freedoms ease. Attitudes remain more traditional in the countryside.

Sociologist and sex expert Li Yinhe said the debate showed the country has come a long way since two decades ago, when displays of public affection and even dancing with members of the opposite sex could be punished.

"The whole social atmosphere has changed. Even in the 1980s the crackdowns were very strong, very severe," Li said. "... In the past, organizing prostitution used to be punishable by death."

She took in the unexpected court verdict with mock horror, saying, "This is simply too subversive."

Breakthrough Research Could Replace Insulin Shots With Pills

Whether you don't like needles, or whether you really don't like needles, there's some good news on the horizon: a special "bioadhesive" coating that was just developed at Brown University is bringing us one step closer to saying goodbye to injections and hello to things like insulin pills.

It's not like people are out there injecting drugs for just fun (well, except for the people out there who are injecting drugs just for fun); injections are crucial for administering protein-based drugs?like insulin?that can't make it through the stomach to the small intestine where they can get absorbed into the bloodstream. The bioadhesive coating developed by researchers at Brown not only lets doses get through unscathed, but also sticks them to the small intestine and dishes them out at controllable speeds.

When researchers coated tons of 500-nanometer particles with the bioadhesive, called PBMAD, and fed them to some lab rats, they found that a PBMAD coating is roughly 20 percent more effective at getting medicines through the stomach acid gauntlet and into the bloodstream than the previous best. And 65 percent better than no coating at all.

The next goal is getting the right medicines to the right parts of the body in the right quantities, but the recent studies have proven that PBMAD is a promising delivery mechanism. Insulin pills might still be a way off, but a future with less needles sounds like a future worth looking forward to. [PhysOrg]

Accordingly, Apple isn't leaving anything to chance: it just posted a page explaining the business-friendly iOS 7 features that it teased at WWDC. The biggest improvements for end users may be enterprise single sign-on and per app VPN, both of which will save hassles when launching work apps. IT managers should have it easier as well -- iOS devices can join Mobile Device Management as soon as they're activated, and a company can assign apps to individual users without losing control. There's considerably more features than we can list here, but it's clear from a cursory glimpse that Apple likes its foothold in the enterprise.

IRS official refuses to testify before Congress

WASHINGTON (Reuters) - An Internal Revenue Service official on Wednesday invoked his right not to answer questions at a congressional hearing, a day after a Republican report accused the official of inappropriately awarding federal contracts worth millions of dollars.

At a U.S. House of Representatives Oversight and Government Reform Committee hearing, Gregory Roseman, an IRS official involved in awarding IRS contracts, repeated four times that he would not answer questions. He was then excused from the hearing.

"I respectfully decline to answer any questions and invoke my Fifth Amendment privilege to remain silent," Roseman said, referring the Constitution's protection against self-incrimination.

Committee Chairman Darrell Issa, a California Republican, released the report on Tuesday that detailed personal ties between Roseman and the president of a Virginia-based government contracting business Strong Castle Inc.

The report also said the company made false statements to beat rivals for the work. Strong Castle, formerly known as Signet Computers, has denied any wrongdoing.

Roseman has been reassigned within the IRS because of his role in awarding the contracts.

IRS deputy commissioner Beth Tucker told the House panel the new information revealed by the committee is "deeply troubling," and that the IRS is taking steps to end its ties to Strong Castle.

The alleged misconduct by Strong Castle and Roseman shows "shockingly inappropriate" behavior and highlights how the company was able to "successfully manipulate the system to acquire contracts," Issa said on Wednesday.

The controversy is the latest in a series suffered by the IRS in recent weeks, most notably an inspector general report that last month said the agency inappropriately gave added scrutiny to conservative Tea Party-linked groups seeking tax-exempt status.

It was the second time in two months that an IRS official refused to answer questions at a congressional hearing.

Last month, Lois Lerner, the former head of the IRS tax-exempt division at the center of the Tea Party groups controversy, angered lawmakers by reading a statement before refusing to testify.

Issa's panel will vote on Friday on whether Lerner waived her Fifth Amendment right by giving a brief opening statement.

Adding satellite WiFi to an airplane isn't as simple as mounting an antenna up top and flipping the switch on a router -- even installing a cockpit printer requires FAA approval, so as you can expect, the Federal Aviation Administration won't check off on major modifications without some thorough testing. JetBlue's new Fly-Fi service is well on its way to getting a formal green light, though, and is expected to launch before Q3 is through. This week, the carrier is running through a variety of flight tests with one of its Airbus A320s, including maneuvering the plane with some pretty unique weight loads, such as the rear center of gravity positioning you can see demonstrated above. After that's complete, it's time to wait for FAA certification before moving onto performance testing, and if all goes well, passengers should expect to hook up to ViaSat-1 from 30,000 feet in mere months. Once Fly-Fi goes online, it'll be by far the fastest commercial in-flight WiFi option -- we really can't wait!

Putin: Snowden, still in Moscow airport, is a 'free man'

The mystery over intelligence leaker Edward Snowden's wherabouts was cleared up today when Russian President Vladimir Putin said he is still holed up in the transit zone of Moscow's Sheremetyevo airport ? not technically Russian territory ? where he has been since arriving on an Aeroflot flight from Hong Kong two days ago.

Mr. Putin, who was on a visit to Finland, told journalists that Russia will not extradite the fugitive whistleblower to the US. Mr. Snowden is "a free man" who may choose his own final destination," he said, calling any suggestions that Russia may have played a role in Snowden's flight from Asia, "nonsense and rubbish."

But in a hint that US diplomatic pressure over the case may be getting to the Kremlin, Putin added that Snowden should hurry up and finalize his travel plans.

Foreign Minister Sergei Lavrov earlier insisted that Russia has no connection to Snowden ? whom, he said in carefully chosen words, "has not crossed the Russian border" ? but at the same time sees no reason to cooperate with the US in capturing him.

"We are in no way involved with either Mr. Snowden, his relations with US justice, nor to his movements around the world," Mr. Lavrov said. "He chose his itinerary on his own. We learnt about it from the media. He has not crossed the Russian border? We consider the attempts to accuse the Russian side of violating US laws, and practically of involvement in a plot, to be absolutely groundless and unacceptable," he added.

The US has demanded "a series of governments" to assist in apprehending Snowden and turning him over to US justice. Analysts say the US and Russia have been engaged in tense dialogue over the past three days as Washington tries to find a recipe for convincing the Kremlin, which sees few reasons to cooperate amid generally deteriorating relations with the US, that it would be in its interests to turn the fugitive whistleblower over.

"We're following all the appropriate legal channels and working with various other countries to make sure that the rule of law is observed," President Barack Obama told journalists yesterday.

Ecuador has said it's considering an asylum request from Snowden. But other countries that have been suggested as possible refuges for him include Iceland, Venezuela, and even Russia. Yesterday Snowden was booked on an Aeroflot flight to Cuba, but he failed to show up, leaving about 30 journalists stranded aboard a 12-hour flight to Havana.

Some analysts say he may have been delayed by Russian special services, who would have an obvious interest in interviewing him and examining the contents of the three laptop computers he reportedly carries with him.

But Wikileaks founder Julian Assange, whose organization appears to be sponsoring Snowden's flight to a safe haven, told reporters yesterday that Snowden is "healthy and safe." On his movements, Mr. Assange would only say: "In relation to the travel out of Hong Kong, that is a fascinating story that I'm sure will one day be told ? but today is not the day."

And in what may be part of a coordinated US effort to bring the Russians around, former NSA and CIA director Michael Hayden granted a lengthy interview to the Kremlin's English-language satellite TV network Russia Today, or RT, in which he responded cheerfully to searching questions from host Sophie Shevardnadze about US intelligence-gathering intentions and methods.

"I think Hayden's appearance on RT, which is quite an unusual kind of event, was a sign of some kind of outreach to Russia. He was making the case that we all have the same kind of problems, should understand each other, work together," says Andrei Soldatov, an expert on the secret services and editor of the online security journal Agentura.ru.

"That's an interesting development, but I don't think the Kremlin would find it practical to cooperate on Snowden. This formula that 'we have nothing to do with it' is a fairly standard Putin way of saying 'no'," he adds.

(AP) ? A deeply divided Supreme Court threw out the most powerful part of the landmark Voting Rights Act on Tuesday, a decision deplored by the White House but cheered by mostly Southern states now free from nearly 50 years of intense federal oversight of their elections.

Split along ideological and partisan lines, the justices voted 5-4 to strip the government of its most potent tool to stop voting bias ? the requirement in the Voting Rights Act that all or parts of 15 states with a history of discrimination in voting, mainly in the South, get Washington's approval before changing the way they hold elections.

Chief Justice John Roberts, writing for a majority of conservative, Republican-appointed justices, said the law's provision that determines which states are covered is unconstitutional because it relies on 40-year-old data and does not account for racial progress and other changes in U.S. society.

The decision effectively puts an end to the advance approval requirement that has been used to open up polling places to minority voters in the nearly half century since it was first enacted in 1965, unless Congress can come up with a new formula that Roberts said meets "current conditions" in the United States. That seems unlikely to happen any time soon.

President Barack Obama, the nation's first black chief executive, issued a statement saying he was "deeply disappointed" with the ruling and calling on Congress to update the law.

But in the South, Alabama Gov. Robert Bentley said that, while the requirement was necessary in the 1960s, that was no longer the case. He said, "We have long lived up to what happened then, and we have made sure it's not going to happen again."

The advance approval, or preclearance, requirement shifted the legal burden and required governments that were covered to demonstrate that their proposed election changes would not discriminate.

Going forward, the outcome alters the calculus of passing election-related legislation in the affected states and local jurisdictions. The threat of an objection from Washington has hung over such proposals for nearly a half century. Unless Congress acts, that deterrent now is gone.

That prospect has upset civil rights groups which especially worry that changes on the local level might not get the same scrutiny as the actions of state legislatures.

Tuesday's decision means that a host of state and local laws that have not received Justice Department approval or have not yet been submitted can take effect. Prominent among those are voter identification laws in Alabama and Mississippi.

Texas Attorney General Greg Abbott, a Republican, said his state's voter ID law, which a panel of federal judges blocked as discriminatory, also would be allowed to take effect.

Justice Ruth Bader Ginsburg, dissenting from the ruling along with the court's three other liberal, Democratic appointees, said there was no mistaking the court's action.

"Hubris is a fit word for today's demolition" of the law, she said.

Reaction to the ruling from elected officials generally divided along partisan lines.

Mississippi Lt. Gov. Tate Reeves, a Republican, said in a news release, "The practice of preclearance unfairly applied to certain states should be eliminated in recognition of the progress Mississippi has made over the past 48 years."

But Democratic Rep. Bennie Thompson, the only black lawmaker in Mississippi's congressional delegation, said the ruling "guts the most critical portion of the most important civil rights legislation of our time."

Alabama Gov. Bentley, a Republican, pointed to his state's legislature ? 27 percent black, similar to Alabama's overall population ? as a sign of the state's progress.

The court challenge came from Shelby County, Ala., a Birmingham suburb.

The prior approval requirement had applied to the states of Alabama, Alaska, Arizona, Georgia, Louisiana, Mississippi, South Carolina, Texas and Virginia. It also covered certain counties in California, Florida, New York, North Carolina and South Dakota, and some local jurisdictions in Michigan. Coverage was triggered by past discrimination not only against blacks, but also against American Indians, Asian-Americans, Alaska Natives and Hispanics.

Obama, whose historic election was a subtext in the court's consideration of the case, pledged that his administration would continue to fight discrimination in voting. "While today's decision is a setback, it doesn't represent the end of our efforts to end voting discrimination," the president said. "I am calling on Congress to pass legislation to ensure every American has equal access to the polls."

Congress essentially ignored the court's threat to upend the voting rights law in a similar case four years ago. Roberts said the "failure to act leaves us today with no choice."

Congressional Democrats said they are eager to make changes, but Republicans were largely noncommittal.

Sen. Charles Schumer, D-N.Y., said he expects Republicans to block efforts to revive the law, even though a Republican-led Congress overwhelmingly approved its latest renewal in 2006 and President George W. Bush signed it into law.

"As long as Republicans have a majority in the House and Democrats don't have 60 votes in the Senate, there will be no preclearance. It is confounding that after decades of progress on voting rights, which have become part of the American fabric, the Supreme Court would tear it asunder," Schumer said.

Attorney General Eric Holder said the Justice Department "will not hesitate to take swift enforcement action, using every legal tool that remains available to us, against any jurisdiction that seeks to take advantage of the Supreme Court's ruling by hindering eligible citizens' full and free exercise of the franchise."

Those federal tools include other permanent provisions of the Voting Rights Act that prohibit discrimination and apply nationwide. But they place the burden of proof on the government and can be used only one case at a time.

The Obama administration and civil rights groups said there is a continuing need for the federal law and pointed to the Justice Department's efforts to block voter ID laws in South Carolina and Texas last year, as well as a redistricting plan in Texas that a federal court found discriminated against the state's large and growing Hispanic population.

The justices all agreed that discrimination in voting still exists.

But Roberts said that the covered states have largely eradicated the problems that caused them to be included in the first place.

"The coverage formula that Congress reauthorized in 2006 ignores these developments, keeping the focus on decades-old data relevant to decades-old problems, rather than current data reflecting current needs," the chief justice said.

Ginsburg countered that Congress had found that the prior approval provision was necessary "to prevent a return to old ways."

Instead, "the court today terminates the remedy that proved to be best suited to block that discrimination," she said in a dissent that she read aloud in the packed courtroom.

Ginsburg said the law continues to be necessary to protect against what she called subtler, "second-generation" barriers to voting. She identified one such effort as the switch to at-large voting from a district-by-district approach in a city with a sizable black minority. The at-large system allows the majority to "control the election of each city council member, effectively eliminating the potency of the minority's votes," she said.

Justice Clarence Thomas was part of the majority, but wrote separately to say anew that he would have struck down the advance approval requirement itself.

Civil rights lawyers condemned the ruling.

"The Supreme Court has effectively gutted one of the nation's most important and effective civil rights laws. Minority voters in places with a record of discrimination are now at greater risk of being disenfranchised than they have been in decades," said Jon Greenbaum, chief counsel for the Lawyers' Committee for Civil Rights Under Law.

The decision comes five months after Obama started his second term in the White House, re-elected by a diverse coalition of voters.

The high court is in the midst of a broad re-examination of the ongoing necessity of laws and programs aimed at giving racial minorities access to major areas of American life from which they once were excluded. The justices issued a modest ruling Monday that preserved affirmative action in higher education and will take on cases dealing with anti-discrimination sections of a federal housing law and another affirmative action case from Michigan next term.

The Alabama county's lawsuit acknowledged that the measure's strong medicine was appropriate and necessary to counteract decades of state-sponsored discrimination in voting, despite the Fifteenth Amendment's guarantee of the vote for black Americans.

But it asked whether there was any end in sight for a provision that intrudes on states' rights to conduct elections and was considered an emergency response when first enacted in 1965.

The county noted that the 25-year extension approved in 2006 would keep some places under Washington's oversight until 2031. And, the county said, it seemed not to account for changes that include the elimination of racial disparity in voter registration and turnout or the existence of allegations of race-based discrimination in voting in areas of the country that are not subject to the provision.

Even if he anticipated the risks involved in turning whisteblower, Edward Snowden can't have imagined the rushed, convoluted journey he'd have to take to avoid the full wrath of the US government. First to Hong Kong; most recently to Moscow, and perhaps soon to Ecuador (via Cuba and Venezuela) where he has apparently made a request for asylum. Strongly worded demands for his capture have followed every step of the way, with the White House National Security Council expressing "disappointment" that Hong Kong allowed Snowden to flee and now urging Russia (which has no formal extradition treaty with America) to "expel Mr. Snowden back to the US to face justice for the crimes with which he is charged." In an effort to help the fugitive navigate the maze of diplomatic fault lines, WikiLeaks has stepped up to say that its own legal advisors are "escorting" Snowden towards his final destination, likely making use of the knowledge they gained while protecting Julian Assange, and that it sees US efforts to arrest him as an "assault against the people."
